CJI directed to CBI to investigate of listing of cases out of turn

Chief Justice of India Ranjan Gogoi, in his administrative capacity as head of the judiciary, has taken note of allegations of listing of cases out of turn before various benches of the apex court, an official said, on the condition of anonymity. He has decided to appoint senior superintendents of police and superintendents of police from the Central Bureau of Investigation (CBI) and Delhi Police, the official said These police officers will be appointed on deputation to keep a tab on suspect listing of cases and other activities of employees and lawyers. Recently, two members of the court staff were dismissed by the chief justice on the allegation of changing an order in a case related to an industrialist. The apex court has also appointed an one man enquiry panel after lawyer Utsav Bains made a sensational allegation that middlemen were active in getting cases listed as per their own wishes. The panel is headed by former Supreme Court judge Justice A K Patnaik.

An Accused on bail can not be arrested-SC

The Supreme Court has held that, in a case where an accused has already been granted bail, the investigating authority on addition of an offence or offences needs to obtain an order to arrest the accused from the Court which had granted the bail. The bench comprising Justice Ashok Bhushan and Justice KM Joseph were considering a an appeal against Jharkhand High Court judgment in which the issue arose was whether in a case where an accused has been bailed out in a criminal case, in which case, subsequently new offences are added, is it necessary that bail earlier granted should be cancelled for taking the accused in custody? The court held that the person who has already been granted bail to be arrested and commit him to custody on addition of graver and non-cognizable offences which may not be necessary always with order of cancelling of earlier bail. गरीब अगड़ों को आरक्षण की समीक्षा करेगा SC, मगर रोक लगाने से इनकार

सुप्रीम कोर्ट ने सरकारी नौकरियों और शैक्षिक संस्थानों में आर्थिक रूप से कमजोर सवर्णों को 10 प्रतिशत आरक्षण देने के फैसले पर रोक लगाने से फिलहाल इनकार कर दिया है. हां इतना जरूर है कि सुप्रीम कोर्ट ने केंद्र सरकार के इस फैसले की नियम-कायदों की रोशनी में समीक्षा करने का भी मूड बना लिया है. मोदी सरकार ने पिछले कार्यकाल में लोकसभा चुनाव से पहले संविधान संशोधन के जरिए आर्थिक आधार पर दस प्रतिशत आरक्षण का दांव चला था. हालांकि केंद्र सरकार के इस फैसले को कई संगठनों ने चुनौती दी है. आरक्षण को नियम विपरीत बताने वाली इन याचिकाओं पर अब कोर्ट तीन सप्ताह के भीतर सुनवाई करेगा. पिछले साल सुप्रीम कोर्ट के फैसले के विपरीत एससी-एसटी एक्ट संशोधन बिल लाकर मोदी सरकार लोकसभा चुनाव के पहले सवर्णों की नाराजगी का सामना करना पड़ा था. जिसके बाद मोदी सरकार ने आर्थिक आधार पर आरक्षण का यह दांव चला था. जिसके बाद कई संगठनों ने 10 प्रतिशत आरक्षण को कोर्ट में चुनौती दी थी. सुप्रीम कोर्ट ने दस प्रतिशत आरक्षण देने के केंद्र के फैसले को चुनौती देने वाली याचिकाओं पर सुनवाई करते हुए बीते फरवरी में केंद्र को नोटिस जारी किया
