बिना शादी पैदा हुए बच्चों को भी मिलेगा संपत्ति का हक

आज सुप्रीम कोर्ट ने अमान्य विवाह से हुए पैदा बच्चो के हक में सुनाया फैसला,  लाइव लॉ की रिपोर्ट के अनुसार यह फैसला केवल हिंदू संयुक्त परिवार की संपत्तियों पर लागू होगा |यह फैसला भारत के मुख्य न्यायाधीश डीवाई चंद्रचूड़ की अगुवाई वाली तीन न्यायाधीशों की पीठ ने रेवनसिद्धप्पा बनाम मलिकार्जुन मामले में दो न्यायाधीशों की पीठ के फैसले के संदर्भ में दिया था| इसमें कहा गया कि अमान्य विवाह से पैदा हुए बच्चे संपत्ति के हकदार हैं | वह अपने माता-पिता की संपत्ति में हिस्सा मांग सकते हैं| हिंदू विवाह अधिनियम 1955 की धारा 16 (3) के तहत अमान्य विवाह से पैदा हुए बच्चों को वैधता प्रदान की जाती है परंतु पैतृक संपत्ति में कोई अधिकार नहीं है केवल माता पिता की संपत्ति ही हिस्सेदारी में ले सकते हैं।

सुप्रीम कोर्ट ने प्राथमिकी के संबंध में निर्धारित कानून को फिर दोहराया और संक्षेप में जानकारी दी

सुप्रीम कोर्ट ने दंड प्रक्रिया संहिता की धारा 154 में दिए गए कानूनी प्रक्रिया एवम प्रावधानों को विस्तार से बताया। इसके अनुसार  1. एफआईआर /प्राथमिकी रजिस्ट्रेशन-  एफआईआर का रजिस्ट्रेशन अनिवार्य है, जब प्राप्त जानकारी स्पष्ट रूप से संज्ञेय अपराध के घटित होने का खुलासा करती हो ।  2. प्रारंभिक जांच-  यदि प्राप्त सूचना या जानकारी स्पष्ट रूप से संज्ञेय अपराध का संकेत नहीं देती है लेकिन जांच की आवश्यकता का सुझाव देती है तो प्रारंभिक जांच की जा सकती है। हालांकि, यह जांच पूरी तरह से यह निर्धारित करने पर केंद्रित होनी चाहिए कि संज्ञेय अपराध का खुलासा हुआ है या नहीं। ये देखना जरूरी है। 3. जांच परिणाम:  यदि प्रारंभिक जांच से संज्ञेय अपराध होने का खुलासा होता है तो एफआईआर दर्ज की जानी चाहिए। इसके विपरीत यदि जांच यह निष्कर्ष पर पहुंचती है या निकालती है कि संज्ञेय अपराध का खुलासा नहीं किया गया तो संक्षिप्त कारणों सहित शिकायत को बंद करने का सारांश एक सप्ताह के भीतर सूचक या मुखबिर को तुरंत प्रदान किया जाना चाहिए।  4. पुलिस अधिकारी की जिम्मेदारी -  एफआईआर दर्ज न करने पर...

Highlights Of Bills Replacing IPC, CrPC & Evidence Act As Stated By Union Home Minister

Union Home Minister Amit Shah on Friday introduced three Bills in the Lok Sabha to repeal the British-era Indian Penal Code (IPC), the Indian Evidence Act (IEA), and the Code of Criminal Procedure (Cr.PC). The Bharatiya Nyaya Sanhita Bill, 2023, which replaces the IPC, prescribes capital punishment as the maximum sentence for mob lynching and suggests 10-year imprisonment for sexual intercourse with women on the false promise of marriage. The Bill, however, states that “sexual intercourse by a man with his own wife, the wife not being under 18 years of age, is not rape”. Mr. Shah said the section on sedition has been repealed. “The Bill for the first time defines terrorism and offences such as separatism, armed rebellion against the government, challenging the sovereignty of the country, which were earlier mentioned under different provisions of law,” he said. The Supreme Court of India on Monday reiterated the guidelines laid down by the top court for arrest under Section 498A of the Indian Penal Code, 1860 and for other offences punishable by a maximum jail term of seven years in its 2014 Arnesh Kumar judgement. Family Court Can Restore Application U/S 125 Cr.P.C After Its Dismissal For Default: Orissa High Court

  The Orissa High Court has held that the Family Courts possess the 'inherent power' to  restore a Section 125 CrPC application dismissed earlier for non-prosecution. While holding so, a Single Bench of  Justice Radha Krishna Pattanaik  observed,  "When a proceeding of maintenance is dismissed on account of default and if it is claimed that the court lacks jurisdiction to restore it in absence of any provision, how it could have been dismissed for non-prosecution, again for having no provision in the Cr.P.C. According to the Court since such is action is predominantly civil in nature, the power to restore a proceeding under Section 125 Cr. P.C. is inherent."  Factual Background: The wife filed an application under Section 125 Cr.P.C. in the Family Court, which was subsequently dismissed for default for non-appearance and non-prosecution.
