SC Issues Notice to Centre on Section 377 of IPC

In a major development today, the Supreme Court has issued notice to the Centre and sought its stand on a petition instituted to decriminalize Section 377 of the Indian Penal CodeSection 377 of IPC categorizes homosexuality as an unnatural offence in India and states that whoever voluntarily has carnal inter­course against the order of nature with any man, woman or animal, shall be punished with imprisonment that can also extend to life imprisonment.
Section 377 of IPC had been set aside by the Delhi High Court in 2009, however, the Supreme Court later set aside the High Court’s judgment and at present homosexuality is a criminal offence in India.
In April this year, the statutory provision had been questioned by businessmen Keshav Suri who alleged that it is the right of every person to live with dignity and without the fear of being arrested.
In view of these newly instituted petitions, the Supreme Court has now sought Centre’s response in the matter.
